Verdicts, Orders & Awards

Not every workers’ compensation case results in immediate relief or a settlement. VERDICT – FINDING AND AWARD: POLICE OFFICER AWARDED RETROACTIVE TEMPORARY TOTAL DISABILITY BENEFITS AND REINSTATEMENT OF GROUP HEALTH INSURANCE BENEFITS

A Finding and Award was issued by the presiding Administrative Law Judge following a Formal Hearing at which the (now retired) Police Officer testified as to his ongoing disability status as confirmed by his treating physician and the Commission Examiner. Retroactive temporary total disability benefits were awarded and ordered paid for a 52-week duration; including interest.

VERDICT – FINDING AND AWARD: EMPLOYEE AWARDED RETROACTIVE BENEFITS FOLLOWING DETERMINATION OF EMPLOYER AT A CONSTRUCTION SITE

Administrative Law Judge ordered payment of retroactive and continuing benefits following a Formal Hearing at which the claimant testified that he fell off a ladder at a construction site while at the direction of his employer. Workers’ compensation carrier contested benefits and employer denied that there was an employee-employer relationship. Administrative Law Judge held that there was in-fact an employer-employee relationship. Case remains open for payment and processing of related medical bills and ongoing indemnity benefits.

AWARD – COMMUTATION (PERMANENT PARTIAL DISABILITY):

Administrative Law Judge ordered a commutation (lump sum payment) of permanent partial disability award considering financial circumstances of claimant. Claimant paid 26 weeks of specific impairment benefits (lump sum payment) consistent with the award.
